Terms of Use Agreement

KHME®EAM Website

These terms apply to all users of the KHME®REAM Website, including users who are not registered. KHME®REAM Website may contain links to third party websites that are not owned or controlled by KHME®REAM. KHME®REAM has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites. In addition, KHME®REAM will not and cannot censor or edit the content of any third-party site. Accordingly, we encourage you to be aware when you leave the KHME®REAM Website and to read the terms and conditions and privacy policy of each other website that you visit.

Modification

KHME®REAM may modify this Agreement from time to time and such modification shall be effective upon posting by KHME®REAM on the khmerream.com Website. You agree to be bound by any changes to this Agreement when you use KHME®REAM after any such modification is posted. It is therefore important that you review this Agreement regularly to ensure you are updated as to any changes.

Liability Disclaimer

You acknowledge that KHME®REAM is not responsible or liable for any action or inaction of any party to a transaction, for any failure to perform, to pay any amounts due, or to deliver any services as promised, or for any other aspect of the transaction. KHME®REAM is not responsible or liable in any manner for any User Content or articles, photographs, text, graphics, pictures, information, and other content or items belonging to or originating from third parties posted on the Site, or in connection with the Service, whether posted or caused by Users of the Site, by KHME®REAM, by third parties. Although KHME®REAM provides rules for User conduct and postings, KHME®REAM does not control and is not responsible for what Users post, transmit or share on the Site and is not responsible for any offensive, inappropriate, obscene, unlawful or otherwise objectionable content you may encounter on the Site or in connection with any User Content.

Right to Change Content.  

KHME®REAM reserves the right to change any and all Content, Services used or contained in the Site at any time without notice. Reference to any products, services, processes or other information, by trade name, trademark, manufacturer, supplier or otherwise does not constitute or imply endorsement, sponsorship or recommendation thereof, or any affiliation therewith, by KHME®REAM.

Fees

You acknowledge that KHME®REAM charges for its service and reserves the right to change its fees from time to time in its discretion.

Password

When you sign up to become a Member, you will also be asked to choose a password. You are entirely responsible for maintaining the confidentiality of your password. You agree not to use the account, username, or password of another Member at any time or to disclose your password to any third party. You agree to notify KHME®REAM immediately if you suspect any unauthorized use of your account or access to your password. You are solely responsible for any and all use of your account.

Copyright Policy

You may not post, modify, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information belonging to others without obtaining the prior written consent of the owner of such proprietary rights. It is the policy of KHME®REAM to terminate Membership privileges of any Member who repeatedly infringes the copyright rights of others upon receipt of proper notification to KHME®REAM by the copyright owner or the copyright owner's legal agent. Without limiting the foregoing, if you believe that your work has been copied and posted on KHME®REAM in a way that constitutes copyright infringement, please provide our Copyright Agent with the following information: (i) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; (ii) a description of the copyrighted work that you claim has been infringed; (iii) a description of where the material that you claim is infringing is located on KHME®REAM, including the specific URL; (iv) your address, telephone number, and email address; (v) a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; (vi) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Permissions and Restrictions

You are only authorized to use KHME®REAM (regardless of whether your access or use is intended) if you agree to abide by all applicable laws, and to this Agreement. Please read this Agreement carefully and save it. If you do not agree with it, you should leave the KHME®REAM Website and discontinue use of KHME®REAM immediately. If you wish to become a Member, communicate with other Members and make use of KHME®REAM, you must read this Agreement and indicate your acceptance during the Registration process. The following is a partial list of the kinds of activities that are illegal or prohibited on the KHME®REAM Website and through your use of KHME®REAM. KHME®REAM reserves the right to investigate and take appropriate legal action against anyone who, violates this provision, including without limitation, reporting you to law enforcement authorities. Prohibited activities include, but are not limited to:

  • registering for more than one User account, registering for a User account on behalf of an individual other than yourself, or registering for a User account on behalf of any group or entity;
  • impersonating any person or entity, including other Members, or falsely stating or otherwise misrepresenting yourself as a real estate professional;
  • intimidating or harassing another person;
  • posting Content that is patently offensive and promotes or includes racism, bigotry, hatred, nudity, links to an adult website, sexual or violent exploitation, or physical harm of any kind against any group or individual;
  • uploading, posting, transmitting, sharing, storing or otherwise making available content that would constitute, encourage or provide instructions for a criminal offense, violate the rights of any party, or that would otherwise create liability or violate any local, state, national or international law;
  • criminal or tortious activity, including but not limited to, child pornography, fraud, trafficking in obscene material, drug dealing, gambling, harassment, stalking, spamming, spimming, sending of viruses or other harmful files, patent infringement, or theft of trade secrets;
  • promoting information that you know to be false or misleading, or promoting conduct that is abusive, threatening, obscene, defamatory or libelous;
  • soliciting personal information from anyone under the age of 18;
  • use or launch any automated system, including without limitation, "robots," "spiders," or "offline readers," that accesses the Website in a manner that sends more request messages to the KHME®REAM servers in a given period of time than a human can reasonably produce in the same period by using a conventional on-line web browser.
  • using the account, username, or password of another Member at any time or disclosing your password to any third party or permitting any third party to access your account;
  • selling or otherwise transferring your profile;
  • using any information obtained from KHME®REAM in order to harass, abuse, or harm another person;
  • using KHME®REAM in a manner inconsistent with any and all applicable laws and regulations.
